Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using www.lunaapro.com (“website”) operated by Luna Architectural Products, LLC (“us”, “we”, or “our”).
By accessing or using the website you (“Buyer”) agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the website.
1. Purchases
If you wish to purchase any product or service made available through the website (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, address and other contact details. You may review our Privacy Policy for more information on how this information is handled.
2. Prices
Prices are subject to change without notice. Seller’s prices do not include any applicable sales taxes or shipping or handling charges. If and when any of these charges are required for the successful completion and delivery of your order, you agree to pay these additional amounts as required.
3. Taxation
Prices do not include Sales Tax. If your order is shipping to an address in the State of New Jersey, Sales Tax will automatically be added to the order. If you are shipping your order to New Jersey and either you or your project is tax exempt, please contact us prior to placing your order.
4. Order Acceptance
No orders will be processed or accepted without payment.
Seller reserves the right to not accept a new order or cancel an existing order if errors are found to exist on the order. These errors may include but are not limited to incorrect product prices and incorrect product descriptions. What constitutes an error is at the sole discretion of the Seller.
5. Order Modification
No changes, modifications or revisions to the order shall be valid unless in writing and approved by a Luna Architectural Products, LLC representative.
6. Payment
We accept MasterCard, Visa, American Express and Discover Card.
7. Delivery
All in stock items will ship out of our warehouse within two business days from order placement and payment in full.
All shipments will be shipped via UPS, FedEx or Freight. We may contact you regarding your shipment choice to offer alternative shipping methods for your consideration. If you require your order to be signed for upon receipt, please contact us as this may result in an additional charge to you.
Shipping charges will be automatically calculated during checkout based on your shipping address.
We suggest you group your items in one order. We cannot group two distinct orders placed separately, and shipping fees will apply to each of them.
The shipping charges listed on your order may include a handling fee. Handling fees are in place to help offset additional costs associated with shipping your order to you.
All shipping and delivery dates provided to you are approximate. Under no circumstances shall Luna Architectural Products, LLC be liable to compensate the buyer for a late delivery, damages or loss of goods during delivery. Once your order leaves our warehouse any claims of damage or missing items are to be handled by the Buyer and the shipping company.
8. Inspection
Buyer is responsible to inspect all goods upon receipt of shipment.
Buyer shall give written notice to Luna Architectural Products, LLC of any defects or damages immediately.
9. Limited Warranty
Luna Architectural Products, LLC represents and warrants to Buyer that at the time of shipment, the products shall be free from faulty workmanship and defective materials. The fore-going warranty shall be limited to a 12 month period from shipping date. Except for this expressed warranty Luna Architectural Products, LLC makes no warranty, expressed or implied including without limitation, implied warranties of merchantability, fitness for purpose or design, or any code compliances.
Upon receipt of returned items believed to be defective, Seller will confirm said defects and once confirmed either a credit will be issued or replacement products will be shipped to you. The choice of remedy is at the sole discretion of the Seller.
10. Custom Items and Standard Items Cut To Size
Custom items and standard items cut to size are not eligible to be returned. All sales on these items are final.
11. Product Use and Code Compliance
Seller makes no representation as to the compliance of any products with any codes or requirements. The determination of compliance is to be determined by you the Buyer.
The Buyer is to ensure the proper, safe and government compliant installation and use of product. Luna Archtectural Products, LLC is not responsible and shall be excluded from any actual or alleged claims associated with violation of any laws, rules, standards or compliant codes.
Further the Buyer will defend, indemnify and hold harmless Luna Architectural Products, LLC and its owners, employees, successors and assigns from and against all costs, damages, liabilities, actions, fines demands, judgements and all legal proceedings resulting from the buyers use or maintenance of the product.
12. GOVERNING LAW/ VENUE
If any dispute arrives from the purchase of products from the website and a mutually agreeable resolution cannot be found, any proceedings shall be conducted exclusively in the county, state or federal courts located in Sussex County, New Jersey. By accepting these Terms Buyer consents to this exclusive jurisdiction.
13. Severability
If any portion of these Terms and Conditions are found to be invalid for any reason, the remaining portions of these Terms and Conditions remain in full effect.
14. Currency
The currency used exclusively on the website is US dollars.
15. Links To Other Websites
Our website may contain links to third-party web sites or services that are not owned or controlled by Luna Architectural Products, LLC.
Luna Architectural Products, LLC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Luna Architectural Products, LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
16. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is made, we will try to provide at least 10 days’ notice prior to any new terms taking effect. It is the Buyer’s responsibility to check our Terms and conditions whenever they visit our website.
17. Our Rights
Luna Architectural Products, LLC reserves the right to modify or withdraw, temporarily or permanently the website with or without notice to you.
Buyer will not be eligible for any compensation because you cannot use any part of the website or because of a failure, suspension or withdrawal of all or any part of the website.
The website is provided ‘as is’ with all faults, and Luna Architectural Products, LLC makes no express or implied representation or warranties of any kind related to the website or the materials contained on this website. Additionally, nothing contained on this website shall be construed as providing consult or advice to you.

18. Indemnification
The Buyer hereby holds harmless and indemnifies to the fullest extent of the law, Luna Architectural Products, LLC from and against any and all liabilities, demands, damages, causes of action, costs and all other expenses (including attorney’s fees) arising out of any neglect or breach of any of the provisions stated in these Terms and Conditions.

19. Force Majeure
Luna Architectural Products, LLC shall not be liable for any breach, loss, injury, delay, damage or other casualty due to causes beyond its reasonable control, such as storms, fire, explosions, acts of God, and breakdown of manufacturing facility.
